Usually one or both parties reach out to the mediator to discuss the situation. The mediator will share information about the mediation process and pricing based off of the type of case, complexity, and scope, and help determine whether this case is a good fit for mediation.

If the parties didn’t already come in together, the mediator will reach out to the other party to share information about mediation and see if they are willing to participate.

If both parties decide to participate, they can split the cost however they choose.

Mediation then usually proceeds one of two ways:

Scheduling a joint session: Mediation can include a joint meeting in-person or over Zoom, usually for 2 hours at a time. The full time may be spent together, or some or all of the time may be spent in individual sessions if it will be helpful to the parties. The mediator will help keep the conversation moving, help parties hear each other, set an agenda, generate options, and write a final agreement if they make one.

“Shuttle” mediation: Mediation can also be conducted with the mediator going back and forth between the parties when they are available, having conversations individually to move things forward, understand the parties’ interests, discuss proposals, and “reality test” solutions.

If parties decide to make a final, written agreement, a document will be sent out for e-signature and both parties will receive a copy.

Sometimes parties are unable to agree on all the issues, but decide to make a partial agreement. Sometimes there is no agreement, but in this case there is often a better understanding of the conflict. If this happens, parties retain the right to pursue other options to resolve the issue.
